• What is a Process Server and Why Do I Need One?

  • A Process Server with Documents

As much as we want them to be, legal proceedings are not always a straightforward process – often things get messy and people can try to avoid their legal responsibilities. This is where a process server comes in. It’s important that those involved in any legal process, no matter the context, are presented with the necessary documents to progress the case and ensure justice is delivered.

    What Is a Process Server?

A process server is an individual responsible for delivering court documents, particularly summons and complaints necessary to start a legal trial. Some defendants will try to evade the service of process and so it is the role of the process server to locate them and present them with these documents.

Why Do I Need a Process Server?

The importance of a process server is to notify that a legal process has begun. It gives the opportunity for the individual to accept the papers and defend themselves in a court of law.

Some may try to dodge their legal responsibilities for fear of conviction, loss of money or assets, or even imprisonment. In such cases, a process server is tasked with locating and ‘serving’ the courts’ legal papers to the defendant.

What A Process Server Can and Can’t Do

Getting people to accept delivery of legal documents and court summons is not always as easy as we’d like – as a result, process servers sometimes have to get creative in how they locate and serve papers.

This could be ‘staking out’ an individual’s home or place of business in order to serve them their papers as they leave. However, a process server is bound by strict regulations, depending on the state, as to how they must conduct themselves and uphold an ethical approach.

For example, a process server is not allowed to impersonate a law enforcement official in order to serve papers. Similarly, they cannot enter private property without permission, or use threats or harassment.

This is why it’s important to select a process serving service that works in an ethical and safe manner, while still delivering on results.
